Terms of use

These Terms of Use apply to the Muuttajan Uki service / application operating on digital channels (also “mobile application” “application” or “service”). The service has been implemented in cooperation with Uusikaupunki and local companies and is managed by FeedCowboy Oy (also the “service provider”). FeedCowboy Oy, Pohjoisranta 11, 28100 Pori, Business ID 2764873-9.

TERMS OF USE

The Terms constitute an agreement between the Service User (including the “Customer”) and the Service Provider and define the rights and obligations of the Customer and the Service Provider with respect to the Service. The application may only be used in accordance with these terms of use. The user must also comply with the conditions set by the network operators, device manufacturers and third parties that require the use of the application.

REGISTRATION AND LOGIN

Deployment of the application requires acceptance of and compliance with these terms. Use of the application requires registration and the provision of address information, telephone number, name and email address to the service provider, which are required to provide the service. A person under the age of 15 may register for the application, provided that the person under the age of 18 has access to the application as stated in the terms and conditions.

Registration for the application is free of charge for the user. Downloading an application from the application store requires the use of a mobile phone with a data connection. A data connection may incur costs for the user.

MOBILE APPLICATION

The application contains information for the user, offers and the Muuttajan Uki benefit card. Other content supporting the application may be added without the express consent of the service provider. Use of the application requires acceptance of the terms of use. The app provides the user with a way to get to know the local businesses and redeem the welcome benefits they provide for one year (365 days) from the time the app is deployed, after which it will cease to operate. The benefits are aimed and collected especially for those who have moved to the city, and they are intended to serve repatriation to Uusikaupunki and to get acquainted with the area's services and companies.

Activation of the service requires that the user has been provided in advance with activation IDs from the party issuing the pre-card in order to register for the service. Other types of login and authentication methods can also be introduced later without new notice to new users of the service.

The user agrees that after registering as a user of the service and logging in to the service, the service will be available to him without a new login until the application is removed or expires. The user must carefully store the device on which he is logged in to the service. The user is responsible for the accuracy of the information provided and for the careful storage and confidentiality of his username and password and for all his transactions with the service in the service and does not disclose his ID or terminal to third parties, as the benefits and card are for personal use.

The user undertakes to notify the service provider immediately if he suspects or discovers that his username has been misused. In this case, the service provider has the right to block the use of the service with the customer's user ID and the possibility to give a new activation code to the customer. The user undertakes not to disclose his / her own IDs to other parties.

By logging in to the application, the user agrees that the service provider can send the user direct marketing in the form of e-mail, text messages or push messages. The permit is also issued to its own card issuer, i.e. Uusikaupunki and its partners.

The user undertakes to provide his / her address information, name, e-mail and telephone number to the service provider. The information will not be disclosed to third parties.

Downloading the application or using the service is an indication that the customer accepts the terms and conditions in force at the time and undertakes to comply with them and the terms and instructions provided separately in the service.

The Service Provider may change these Terms at any time in its sole discretion. Changes to the Terms will take effect when they are posted on the Service. The customer is considered to have accepted the amended terms and conditions if he continues to use the service after the change notice.

The app is available for Android and iOS operating systems. The application is not intended for use on a tablet device.

USING THE MOBILE APPLICATION

The Service Provider grants you a limited, revocable, non-exclusive and personal right to use the Service and its content, as defined in these Terms, only in accordance with these Terms and any terms and instructions that may be given separately in the Service for the period of time.

The user has the right to use the service and its content only for the customer's own, non-commercial use, nand the content of the application may not be redistributed or copied in any way, in whole or in part, and all rights to the service are reserved. If the customer does not comply with these terms of use, his data may be deleted unilaterally by the service provider without prior notice.

The user may not modify or reproduce the service or its content or any part thereof. You also have no right, as such or as modified, to distribute, distribute, transmit, publicly or otherwise make the Service or its content available to the public unless expressly authorized to do so in these Terms. You may not use the Service in violation of these terms, the law or good manners.

RESPONSIBILITY OF THE SERVICE PROVIDER

The Service Provider reserves the right to modify or change the Service and to terminate or close the Service at any time, in whole or in part, without notice to you.

The service provider is not responsible for ensuring that all content presented in the application complies with Finnish law or good taste. The service provider does not guarantee that the application will work properly or that the application will be available without interruption. The service provider is notresponsible for factual errors or declared benefits, but the companies that issue and report / market them are always responsible for them. The service provider is not liable for damages if the company granting the benefits does not grant the user an advantage.

The service and its content are provided to the customer “as is”. The service provider is not responsible for the correctness, reliability, errors, omissions, inaccuracies or other defects of the information or content transmitted in the service, or for exceptional technical problems or, for example, service interruptions.

The service provider cannot guarantee the security of the service, its content or the information transmitted through the service, nor is it responsible for ensuring that the service or the electronic bulletins sent through it do not contain viruses or other harmful elements. Furthermore, the service provider is not responsible for the data sent or received by the customer via the service, or for any data or content that is not sent or received, or for any other content that the service collects now or in the future.

The service may not be available in all countries, and may only be available in certain languages or for certain groups of users. The service, its operation, or some features may depend on the compatibility of the devices used, network connections, and content formats. If you have not accepted or configured your phone correctly to use the service, your service provider is not responsible for providing technical support for modifying your phone settings.

The service provider is not responsible for the services and marketing or other information contained in the links to the websites or other services of other service providers in this application. The marketing and advertising of each product or service is the responsibility of the marketing and advertising through the application.

The Service Provider shall not be liable for any direct, indirect, consequential or indirect damages or special damages arising out of the loss or interruption of business, contract, revenue or information resulting from the use or obstruction of the Service or its content, regardless of these terms. Whether the damage is based on a contract, an infringement, negligence or any other ground, even if the service provider has been notified in advance of the possibility of such damage. In all cases, the liability of the service provider is always limited to the maximum liability under mandatory law. The service provider has no financial responsibility beyond this.

PROCESSING OF PERSONAL DATA

The service provider takes proper care of the processing and storage of customer data. Personal
information is required for an optimal user experience of the application as well as for resetting user IDs.

The user agrees that his / her personal data may be used in connection with the use of the application in
accordance with the privacy statement found at slice.fi/muuttajanuki, which complies with the applicable
law.

COOKIES AND LOCATION

The service provider may use cookies (also called cookies) in the service or on the websites or advertisements that market it. A cookie is a small text file stored in an Internet browser (for example, Internet Explorer) in connection with transactions in the service, which enables the tracking of customers (also called visitors) visiting the service.

For example, cookies allow us to process the number of users of the service and other information related to the use of the service. With the help of the information obtained, the operation of the Service can be analyzed and developed to be better and more individual for the customer. The use of cookies also makes it possible to compile various aggregate information about the customers who use the service. In addition, the information collected can be used to target marketing to the customer that is likely to be of interest to them in the service and outside the service, for example by utilizing retargeting.

The use of cookies is secure and does not harm users' computers or files. If you wish, you can disable the use of cookies in your Internet browser settings but disabling cookies may still affect the proper operation of the service. It is also recommended that you give the app all the permissions requested by your phone in the settings to get the full-service experience.

Utilizing the service may involve the processing of location information. In order to use the service, the customer must accept that the service provider can process the customer's location information to the extent required to provide and utilize the service. The service provider does not process location data for purposes other than those stated for which the customer has given his consent. Location information will not be shared with third parties.

INTELLECTUAL PROPERTY RIGHTS

All image and text materials (product images, texts, videos, logos, tables) presented in the service are the property of the service provider and / or its partners. Unauthorized use or copying of copyrighted images and text is prohibited. The Service Provider does not grant the Customer any direct or indirect rights to any intellectual property rights.

JURISDICTION AND APPLICABLE LAW

The use of the Service and these terms and conditions are governed by Finnish law, except for its conflict of law provisions. The parties shall endeavor to resolve their differences primarily through negotiations. If no amicable settlement is reached, the disputes will be settled in the Pori District Court in Finland. Theconsumer customer may also take the dispute to a competent district court or consumer dispute board determined by their domicile.

OTHER TERMS AND CONDITIONS

The mobile application will be made available to you, for example, through the Apple App Store or other app stores, and will be subject to the terms of that service provider in addition to those terms. The customer must also take into account the conditions set by the network operators, equipment manufacturers and other third parties, which may be a prerequisite for using the service.

The goal of the service provider is to provide users with an easy and convenient way to browse, publish and redeem benefits and take advantage of a mobile loyalty / membership card. The goal of the service provider and the party issuing the discount card is to collect significant benefits, discounts and useful bulletins in a targeted manner for the users of the service. The information will be processed in accordance with applicable law and will only be used in connection with the service. By accepting all three points, you will reap the full benefits and not only share important targeted, but service also-related bulletins.

If you wish to log in to the service with other third-party designated authentication services or otherwise authorize the service by demonstrating and separately explicitly accepting the service at a later date, you agree to the required data transfer between all service resources and those maintained by the service provider's partners.
